BERLIN — The Berlin Zoning Board of Appeals voted 6-0 to grant a third continuance of a Three Gates Pond Road special permit hearing after abutter notices again went out improperly. Chair Lynn Ryan said the petitioner, architect Guzman of Guzman Architects, had now failed three separate times to send legally required hearing notices, with only 13 of 15 required return-receipt slips submitted and none completed with a name or address. Representative Jonathan Otto said two earlier failed mailings cost roughly $82 and $160.
Member Keith Soucy warned of "calculated incompetence" but supported a conditional continuance, saying "if anything else goes wrong again, then we're done." The hearing was continued to September 9 at 7 p.m., conditioned on a corrected, certified-mail notice. The board also recommended alternate Joshua Martin for an open regular seat after member Pat Jackson said she plans to leave to become a town registrar.
